1. Introduction
DA PLUG (“the Platform”, “we”, “us”, or “our”) is an online marketplace connecting customers with independent service providers (“Plugs”) across South Africa.
By using da-plug.co.za or any DA PLUG services, you agree to be bound by these Terms and Conditions. If you do not agree, you must stop using the Platform immediately.
2. Platform Role and Limitation
- DA PLUG does not employ or control Plugs. Plugs are independent contractors providing services directly to customers.
- DA PLUG acts solely as a platform facilitator to:
- Connect users with service providers
- Enable online bookings
- Facilitate secure payments
- DA PLUG is not responsible for the quality, timing, or performance of services provided by Plugs.
3. User Eligibility
- Users must be at least 18 years old or have legal capacity to enter contracts.
- Plugs must provide accurate identification, business verification, and relevant licenses if applicable.
4. Accounts and Registration
- Users must provide truthful and accurate information when registering.
- Users are responsible for maintaining the confidentiality of their login credentials.
- You agree to notify DA PLUG immediately of any unauthorized account access.
- Accounts may be suspended or terminated for violations of these Terms.
5. Booking and Payment
- All bookings are subject to availability and confirmation by Plugs.
- Payments are processed through DA PLUG and held for 7 days to ensure service delivery and customer protection.
- Refunds and cancellations are governed by the Customer Protection, Refund & Returns Policy.
6. Plugs’ Responsibilities
Plugs agree to:
- Provide services as described in their profile.
- Deliver services safely, professionally, and legally.
- Comply with all applicable laws and regulations.
- Follow the 7-day payment holding and protection policy.
- Not attempt to bypass DA PLUG for bookings or payments.
7. Prohibited Conduct
Users and Plugs must not:
- Engage in illegal activity, harassment, or fraud
- Misrepresent services, qualifications, or identity
- Reverse engineer, copy, or exploit the platform’s software, processes, or content
- Share sensitive customer information or use it outside the platform
- Manipulate ratings, reviews, or disputes
8. Intellectual Property
- All DA PLUG branding, content, software, and system designs are proprietary and protected.
- Unauthorized use, reproduction, or distribution of DA PLUG intellectual property is strictly prohibited.
9. Liability Limitation
- DA PLUG is not liable for indirect, incidental, or consequential losses arising from platform use.
- Refunds are limited to amounts paid through DA PLUG for bookings or rentals.
- DA PLUG is not responsible for Plugs acting outside the platform or off-platform agreements.
10. Privacy and Data Protection
- DA PLUG complies with POPIA and protects user data in accordance with the Privacy & Data Protection Policy.
- Users consent to the collection, storage, and processing of personal information as described in the Privacy Policy.
11. Dispute Resolution
- Users should contact DA PLUG support for any issues.
- DA PLUG may mediate disputes between customers and Plugs.
- Legal disputes are governed by South African law.
12. Changes to Terms
- DA PLUG may update these Terms at any time.
- Continued use after updates constitutes acceptance of the revised Terms.
